Get to know the requirements for applying for Australian visas

AAT

visa image

If your visa application is refused or your visa application has been canceled? You may have another opportunity to present your case and get your visa. The Administrative Appeals Tribunal (AAT), an independent review body that reviews decisions made by the Department of Home Affairs (DoHA), especially visa refusal and cancellation decisions. If you have had a visa application refused and wish to have that decision reviewed (appealed), the AAT may offer an opportunity to get the decision reviewed and possibly, reversed.

The AAT represents a “last chance” opportunity for visa applicants and holders of canceled visas to have an independent review of their case based on the merits of the case. Further review after the AAT is available from the courts, however the courts cannot review the merits of the case; they can only determine if a mistake was made in the process of refusal or cancellation. And unlike the courts, at the AAT you can introduce new evidence to support your visa application or argue against cancellation – the AAT review is essentially a completely new review of your case and offers an excellent opportunity to remedy any problems in your original application.

The most common reasons why visas are refused or canceled:

The Australian visa application process is very complex, and the rules and requirements for visas change often. Most visa problems are based on the applicant’s lack of knowledge about the Australian visa system, or a mistaken belief that the Australian visa system is flexible – it is not. In fact, most visa application refusals can be traced back to on one or more of the following common problems:

  • incomplete or inaccurate applications
  • lack of proper supporting documentation
  • poorly prepared applications and documents which do not meet the legislative requirements for the visa being requested
  • poor quality supporting materials that cause DHA to believe the visa applicant’s request is not sincere or genuine
  • poor advice from unregistered or inexperienced immigration advisors

The AAT: A renewed opportunity to set things right:

The AAT offers visa applicants a chance to address whatever problems caused the visa refusal, but applicants only get one chance for an AAT review, so it’s important to make sure that an AAT review is done correctly, with the best possible written submission and supporting materials.

Our AAT review service offers a comprehensive package of benefits designed to present your case in the best possible way to the MRT including:

  • A thorough review of your case and the reason(s) for the refusal or cancellation
  • Review of your existing supporting documents and suggestions for improvement where necessary
  • Assistance with preparation of witness statements and other supporting documents
  • Review of previous legal cases and precedents that may support your visa application
  • Creation of a thorough written submission for your AAT review and all forms required by the AAT
  • Lodgment with the AAT and handling all communications from the AAT regarding your case

Your visa status in Australia can also be affected by an AAT review – if you are currently on a bridging visa, your visa can be extended if you lodge an AAT review within the required time limit after notification of your refusal or cancellation.

There are strict time limits imposed by the AAT which cannot be extended. Contact us immediately if you wish to pursue an AAT review and we can advise you of your options, your time limits, and how we can create and lodge your case documents with the AAT for the best possible chance at success.

Australian citizenship is the primary goal for many migrants who come to Australia under various migration programs. Acquiring Australian citizenship allows you to have the same rights and privileges as any other Australian citizen, including the right to vote, work in the Australian Government Service or the Defense Force, and obtain and use an Australian passport. Citizens who have been granted citizenship on application have the same responsibilities as other Australian citizens, including serving on a jury and defending Australia if necessary.

Partner Visa

If your partner has permanent residence or citizenship in Australia and you would like to apply for a Partner Visa, feel free to book a consultation to explore your visa options and prospects of success. We can represent you for complex family and partner visa matters
There are three general types of Partner visas that allow Australian citizens, permanent residents or eligible New Zealand citizens to sponsor a spouse, fiancé, or de facto partner to migrate to Australia.
Partner visas are typically issued in two steps – first, a temporary or provisional visa is granted to the partner which has a duration of 2 years. Near the end of that period, DoHA will issue a permanent resident visa if it is satisfied that the relationship still meets the requirements for the visa. In some cases where children are involved or the relationship can be established to be long-term, the partner will be issued the permanent resident visa first, without the need for the provisional visa and the 2 year waiting period.
Two other important aspects to consider with Partner Visas are whether there are any serious health issues or past character issues (such as convictions) which could prevent the partner visa from being granted. Health waivers are available in some cases, and we can work with you to determine if a health waiver is necessary and put together the supporting documentation and submission package to request this.

Domestic Violence

Australian visa law has special considerations for situations where a sponsored partner becomes the victim of domestic abuse. In many cases, the abuse victim is able to proceed to permanent residency in Australia even if the Australian sponsoring partner is no longer in the relationship due to established concerns or evidence of domestic violence.
If you are in this situation, we can help you understand and work with the special provisions of the Australian visa laws that are intended to benefit victims of domestic abuse who are married to Australians but have not completed the path to permanent residence. As always, all information given to us is held in the strictest confidence.
These visas allow an Australian citizen or permanent resident who is married to sponsor his or her spouse for permanent residency in Australia. For married couples, one of the key issues with obtaining this type of visa is establishing to the satisfaction of the Department of Home Affairs (DHA) that the marriage is genuine. We can work with you to create a submission package to accompany your visa application that will provide the strongest support for your spouse visa
A De Facto relationship is a long-term relationship between two people not related to each other who are not married but live in a similar manner as married people do and have a mutually exclusive relationship with each other. For de facto relationships, DoHA requires that there be at least 12 months of cohabitation (living together), and an important aspect of this type of visa is providing strong documentation, pictures, and other items to demonstrate that the relationship is sincere, genuine, and ongoing. As with the spouse visa, we will work with you to create a strong and compelling documentation and submission package to accompany your visa application in order to present your case with the right documentation and proofs to DoHA regarding your relationship.
The Prospective Marriage (Fiancé) visa is a temporary visa that allows an applicant who is outside Australia to travel to Australia to marry their partner. The visa has a strictly limited duration of 9 months and must be issued to the applicant outside Australia. Once the applicant comes to Australia and marries, the couple can then apply for a Partner (Spouse) visa in Australia, and the applicant will be granted a Bridging Visa to allow him or her to remain in Australia until the Partner visa process is complete.
If a visa applicant comes to Australia on a Prospective Marriage visa and for whatever reason no longer remains in a relationship with the Australian sponsor, there are provisions by which the visa applicant may change sponsors to a different sponsor should the applicant choose to do so.
